1. Independence & Nature of AGROHA

AGROHA Business World operates as an independent, community-based professional forum rooted in cultural affinity, shared values, mutual trust, and voluntary participation among Agrawals.

Membership in AGROHA:

• Is community-oriented and not commercially restrictive
• Arises from social and cultural association rather than commercial compulsion
• Does not conflict with membership in any other business, professional, or networking organisation
• Is entirely voluntary and non-exclusive, imposing no direct or indirect limitation on any member’s professional, commercial, or entrepreneurial engagements

These principles are consistent with the freedom of association recognised under Article 19(1)(c) of the Constitution of India.

2. Freedom of Trade, Profession & Association

Every individual enjoys the fundamental right under Article 19(1)(g) of the Constitution of India to practice any profession or to carry on any trade, occupation, or business.

Accordingly:

• No person can be compelled to restrict their professional or business networking to a single organisation.
• No private body has legal authority to restrain, interfere with, or influence an individual’s right to join any lawful community, cultural, professional, or networking forum.
• Any restraint not backed by valid contractual obligations is unenforceable under ordinary contract law and contrary to constitutional freedoms as guaranteed to every individual.

3. Position Under the Competition Act, 2002

AGROHA Business World fully adheres to the principles of fair competition as mandated under the Competition Act, 2002, particularly:

• Section 3(1): Prohibits agreements that cause an Appreciable Adverse Effect on Competition (AAEC)
• Section 3(4): Prohibits exclusive supply, refusal to deal, and similar restrictive trade practices

Therefore, any attempt by any third-party organisation to:

• Restrict individuals from joining AGROHA
• Control or prevent participation in a lawful community-based forum
• Impose exclusivity beyond reasonable internal conduct rules
• Create coercive conditions affecting networking freedom

may constitute anti-competitive conduct and is not legally sustainable under Indian competition law.

4. No Third-Party Authority Over AGROHA Membership

AGROHA Business World affirms that no third-party organisation has any legal, contractual, or statutory authority to prevent or restrict an individual from becoming a member of AGROHA. Membership is voluntary, lawful, and rooted in community participation, subject only to any independently and willingly executed contractual obligations members may have with other organisations.

AGROHA respects all such external commitments and does not interfere with or comment upon any individual’s contractual relationships elsewhere. Participation in AGROHA, by its nature, does not create any conflict of interest with involvement in other professional, business, or networking forums.

The official statement of AGROHA is supported by Section 27 of the Indian Contract Act, 1872, which renders void any agreement that imposes an unreasonable or unlawful restraint on a person’s freedom to practice a trade, profession, or business. Therefore, any external attempt to restrict or influence AGROHA membershipwithout a valid and legally permissible contractual basisis unenforceable under Indian law.

5. India’s Longstanding Community-Based Networking Ecosystem

Across India, numerous community-based, professional, social, and business forums exist and function lawfully for various communities and professional groups.

These platforms are:

• Well-recognised social and professional associations
• Formed for interaction, collaboration, cultural cohesion, and mutual development
• An integral part of India’s diverse socio-business ecosystem

6. Protection & Respect for Our Members

AGROHA Business World firmly stands for the autonomy, dignity, and lawful rights of its members.

Any act that:

• Seeks to intimidate or coerce members,
• Attempts to restrict their freedom of association, or
• Interferes with lawful participation in AGROHA

will be viewed seriously and, if required, addressed through appropriate legal and regulatory remedies.

7. Mutual Respect & Lawful Coexistence

AGROHA Business World respects all organisations and networking platforms and believes that:

Ethical coexistence, free choice, and healthy competition strengthen the business ecosystem.

While extending respect to all platforms, AGROHA firmly asserts its independence and lawful right to function as a community-driven forum for social interaction, collaboration, knowledge-sharing, and business relationship building among members of the Agarwal community.

9. Dispute Resolution & Arbitration

Any dispute between members, or between a member and AGROHA, shall first be referred by the aggrieved in writing to the AGROHA Board for mutual and amicable settlement. If not resolved within 30 days, the matter shall be referred to a sole arbitrator under the Arbitration and Conciliation Act, 1996. The sole arbitrator shall be appointed by AGROHA Board, failing which appointment shall be made as per Section 11 of the Act of 1996. The seat of arbitration shall be Jaipur or Udaipur, and the award shall be final and binding.
